Complete disrespect of GDPR laws

The reason I am writing this review is to inform possible customers of the company continuously functioning not in accordance with EU GDPR laws. I contacted them per email roughly half a year ago in order to ask for a quote for bus transportation. As the quote was by far the most expensive quote that we received, I did not even answer to the email in any way. However, some months after the company started spamming me for example asking if I would want to buy more bus transport from them. The unsolicited email was disguised as a "personal" email, even though it was very generic and probably auto-generated. This means that they had against the law saved my personal information in their databases and used this data for illegally sending unsolicited email without the active consent of the recipient. They would not have even any right to save any of my personal data based on an ongoing business relation, as there was none. When I contacted them in order to ask why I am receiving spam from them despite I never have given them my consent to store or use my personal data nor to receive spam from them, I received a half-hearted response claiming that by filling out a form on their website, I had given them the right to store and use my personal data and to receive spam from them. I never filled out any form but sent an direct email, which they even sent me a screenshot of. Even if I did have filled out a form on their website they would have needed to ask for consent in that form. They also claimed in the same email that my data has now been deleted and that it is not going to be used for spamming anymore. Neither of this proved to be true as I started receiving even more spam in the weeks to come. After contacting them they tried to weasel themselves out of the situation by claiming that the company is a small one man company and that is why it is hard for them to comply with the regulations and that receiving more spam was some sort of a data glitch. As if a small company would be any more eligible to break the law. As should be their legal responsibility, they promised to send me a copy of my data that they have illegally saved in their databases as well as a comprehensive explanation how and why they have been breaking the law and which actions they have taken in order to comply the law in the future. They promised to provide me with this information no later than 6th August, which never happened. I allowed an extra week but have received no answer whatsoever. Then they claimed that no law required excerpt of my personal data was not sent to me, because there wasn't any data in their databases. This is a strange thing to claim, as they clearly stated that my email address was stored in their database and spamming list and that my consent had been removed. I strongly recommend to not make any business with this kind of a company. Although the company is listed to be located in Paris, France, and the website lists out several international office locations, it seems to be working from a rural area in Latvia. I guess they just send quote requests by email to several international bus companies that actually own their vehicles and get overheads from that. One can easily do that by themselves direct to companies with bus fleets and save a bunch of money while doing it. I have now informed the authorities on the illegal activities carried out by this company and really hope they will take strict action on companies like this. I really hope that this review reaches as many as possible people that are concerned about their privacy and data protection rights guarded by EU law. I also hope that I will never in the future be treated like this by anyone. And as the owner already stated; we were very fortunate of that we never got to to point of making any purchase from this company.

Dear Erik, We are genuinely sorry that two emails from BusCom following your previous transport enquiry have resulted in such an extensive dispute and a review of a service you have never actually used. For anyone reading this review, some important context is necessary. You contacted BusCom requesting a quotation for group transportation and chose not to proceed. You never booked a service with BusCom, never paid BusCom anything and therefore have no experience of the transportation services we actually provide. Some months later, we contacted previous enquirers whom we believed could reasonably be interested in group transportation again. You received two communications: one regarding potential future transport requirements and one marketing campaign. You objected, we apologised, and the email addresses concerned were subsequently placed on our global campaign exclusion list to prevent further BusCom marketing campaigns. We acknowledge that our handling of this could have been better. We have taken your complaint seriously, reviewed our procedures and are improving our privacy and marketing processes. We will also cooperate fully with any competent data-protection authority should they contact us. What we cannot accept is using this isolated marketing dispute to portray BusCom and its transportation services as something they are not. BusCom is a legitimate European group-transport business registered in Latvia. This has never been a secret. We organise transportation throughout Europe through our own transport resources and a network of trusted professional operators. In several markets we have dedicated arrangements with operators and vehicles operating under the BusCom brand. This model allows us to provide everything from individual transfers to complex multi-country European tours without being limited to one local fleet. Paris, Munich, Amsterdam and other cities referenced by BusCom are key operational markets. They do not imply that we own a physical bus depot in every city. Regarding your comment about our quotation being expensive: coach prices depend heavily on dates, location, availability, empty mileage, vehicle requirements and notice. Sometimes our price is extremely competitive; on another date or location, a local operator may be cheaper. Every customer is completely free to compare quotations and choose the best solution. It is also important to distinguish criticism of our marketing procedure from criticism of our actual service. You have never travelled with BusCom or booked transportation through us, yet you strongly recommend that nobody use our company. Our actual customers are in a considerably better position to judge the quality, reliability and organisation of the services they have received from us. We work extremely hard every day to find transportation solutions for groups throughout Europe. BusCom is a small business and I personally wear several hats rather than having separate departments for every aspect of the company. That does not exempt us from our responsibilities. When something can be improved, we acknowledge it, learn from it and improve. Marketing is one area where this situation showed us that improvements were necessary. We will not repeat the same mistake, and your complaint has contributed to improving our procedures. For that feedback, we thank you. We simply hope readers will distinguish between receiving two unwanted marketing communications following a genuine previous transport enquiry, with the ability to unsubscribe, and the quality, legitimacy and reliability of the European transportation services BusCom actually provides. The group and I liked the friendliness of the drivers. They could be more informed about coming to the sights and interesting places. It wasn´ t so good that drivers changed 4 times in 5 days. Information about the meeting point and mobile number of the driver was only on the arrival day possible!

Wir sind Reiseveranstalter und fahren mit kleinen Gruppen durch verschiedene Länder Europas. Aufgrund der Größe der Gruppe haben wir diesmal entschieden, nicht mit den Wohnmobilen nach Belgrad zu fahren, sondern vom Stellplatz mit dem Bus nach Belgrad und zurück.
